Compensation for accident victim increased to Rs 4,00,200
The Calcutta High Court has increased the compensation for a man who became 80% disabled following a motorcycle accident. This decision came on Wednesday as the court set aside an earlier compensation amount decided by the Motor Accident Claims Tribunal. The previous compensation was only Rs 30,200, but the court has now raised it to Rs 4,00,200. The increase was based on various factors including the victim's annual income, loss of earnings, and future medical expenses. The victim, Madhab Ghosh, was involved in the accident in 2012 when his motorcycle was hit by a mini truck. His wife filed a claim for Rs 5 lakh, stating that the accident left her husband unable to work. Ghosh's lawyer noted that due to his severe disability, he could not appear in court. Justice Prasenjit Biswas agreed that Ghosh’s monthly income of Rs 4,500 was reasonable. The judge also added that Ghosh was entitled to additional compensation related to future income potential since he was self-employed at the time of the accident.
