DA Anne Donnelly seeks changes to discovery law
Nassau County District Attorney Anne Donnelly is traveling to Albany to advocate for changes to what she describes as a "pro-criminal" discovery law. This visit marks the beginning of her re-election campaign. Donnelly, a Republican, emphasizes her record of prosecuting violent criminals and protecting law-abiding citizens. Donnelly, who has over 32 years of experience, criticized the impact of Cashless Bail and Discovery Reform Laws on public safety. She plans to hold a press conference with state Senate Minority Leader Robert Ortt to press for revisions to these laws. Donnelly believes that these laws have created a situation in which criminals can avoid justice, leaving victims to suffer. The discovery law was enacted in 2019 and requires prosecutors to quickly share evidence and witness information with defense attorneys. Donnelly argues that the tight deadlines are unmanageable for prosecutors with heavy caseloads. She has noted that small errors, often unrelated to the crimes, can lead to serious cases being dismissed. Donnelly advocates for changes such as limiting the type of information shared with the defense and reducing the time defense attorneys have to challenge discovery certifications. She raised concerns about sensitive information being exposed, such as a victim's contact details being given to their attacker. Governor Kathy Hochul has also expressed support for revisions to the discovery law, influenced by feedback from the state District Attorneys Association. Donnelly was first elected as DA in 2021 after defeating Democratic state Senator Todd Kaminsky, who had supported the 2019 laws. She has worked on high-profile cases, including the Gilgo Beach serial killer investigation. Donnelly asserts her commitment to public safety and insists that her fight for reforms is far from over.
