Dave Mahon accused of assaulting neighbor at barbecue
Dave Mahon, aged 53, is facing trial for allegedly assaulting his neighbor, Jim Fahy, who is 73 years old. The incident reportedly took place during a barbecue at Fahy's home on August 26, 2021. The prosecution claims that Mahon assaulted Fahy, causing physical harm. A key witness, Noel Byrne, testified that he was present at the barbecue. He described the atmosphere as friendly at first, with guests enjoying drinks and food preparation. However, Byrne noted that the mood shifted when a conversation between Mahon and Fahy became tense. Byrne said he heard shouting from outside and later saw Mahon headbutt Fahy in the living room. He indicated that there was a brief scuffle, during which Mahon was on top of Fahy and punches were thrown. Byrne claimed there was blood on the floor and that the altercation lasted about ten to twelve seconds. During cross-examination, Mahon's defense attorney, Peter Nolan, questioned Byrne's memory of the event and his level of intoxication at the time. Byrne admitted to having consumed alcohol but insisted he could recall the key moments of the incident. The defense suggests that Fahy initiated the conflict and was aggressive.
