Delhi High Court allows Adyar Gate Hotels to use 'Dakshin' name for Chennai restaurant
The Delhi High Court has allowed Adyar Gate Hotels to use the name 'Dakshin' for its existing restaurant in Chennai. This decision reverses a previous order that restricted its use due to claims from ITC Ltd regarding trademark infringement. The court noted that Adyar Gate Hotels has used the 'Dakshin' mark since 2015 without objection. However, the hotel is not permitted to expand its use of the name until a further hearing on March 18. ITC Ltd claims ownership of the 'Dakshin' trademark, which it registered in 2000. The dispute arose after Adyar Gate opened a standalone restaurant using the name in December 2023, following the closure of a hotel where the name was previously used.
