Deputy charged with murder in Alamogordo shooting case
An Alamogordo judge has found enough evidence to charge Otero County deputy Jacob Diaz-Austin with first-degree murder in the June shooting of 17-year-old Elijah Hadley. The case will proceed to trial in the 12th Judicial District Court. Hadley was shot while holding an airsoft gun during a welfare check on June 25. Video evidence shows Hadley claiming, "It's just a BB gun," after being shot. Diaz-Austin is currently on paid administrative leave and will remain employed unless convicted. His attorney previously sought to dismiss the case, but the motion was denied.
