Employees can claim unpaid commissions and benefits in UAE

A worker in the UAE has raised concerns about unpaid commissions and end-of-service benefits after switching to a commission-only pay system. The worker has been with the same private company for over five years, but has not received commissions for more than four years. According to UAE Labor Law, the worker can claim unpaid commissions for the last two years only. If the company acknowledges its debt in writing, the worker may claim all owed commissions from the last four years. For the end-of-service benefits, these will be calculated based on the new commission system, since the worker signed an agreement to this effect. The law states that employment contracts can change if both parties agree. In this case, the worker accepted the new commission structure, which will influence the calculation of labor rights. Furthermore, end-of-service benefits should be calculated similarly to piecework wages, based on the average earnings over the last six months.
