HC demands UP government respond on Gangsters Act compliance
The Allahabad High Court has raised concerns about the improper implementation of the UP Gangsters Act. The court issued a directive that any gang chart prepared must include all required details in the correct format. Additionally, a separate list of the individual's criminal history must also be provided. In this case, the court has stayed the arrest of Jai Prakash Bind, also known as Neta, who is from Bhadohi. He is facing charges under the Gangsters Act. Bind filed a petition seeking the cancellation of the First Information Report (FIR) against him. The court discovered that the gang chart submitted only showed one criminal case in its sixth column. However, the state counsel stated that there were four cases listed in the fifth column, but not detailed as required. The court emphasized that there are clear rules for providing this information that have not been followed. The division bench, consisting of Justice Siddharth and Justice Praveen Kumar Giri, reminded officials that previous court orders on this issue were also ignored. Therefore, the court instructed the home secretary and the director general of police to ensure compliance with these regulations. The court has now requested a reply from the state government regarding this matter.
