Lawsuit claims negligence in Covington day care death
The family of a 4-month-old baby, found unresponsive at a Covington day care, has filed a wrongful death lawsuit against the facility. They claim the owners were negligent and misled them about the care provided at the day care. On February 7, emergency responders arrived at Little Treehouse Learning Center after a staff member called 911. The employee reported finding the infant not breathing while checking on him during nap time. A dispatcher asked how long the baby had been unresponsive, and the employee estimated around 30 minutes. The child was taken to St. Elizabeth Edgewood but was pronounced dead shortly after arrival. While police indicated that there was no initial evidence of criminal activity, the family believes negligence at the day care led to their child's death. According to the lawsuit, staff members fed the baby around 2 p.m. and laid him down for a nap by 2:28 p.m. 911 calls began around 3:39 p.m. The situation escalated when the employee reported the baby was throwing up, and emergency instructions were given to perform chest compressions. The family alleges that the baby choked, partly due to a "white noise" machine that masked any sounds of distress. They also noted the absence of surveillance cameras at the facility, despite being told there was constant monitoring. Additionally, the lawsuit referred to 21 violations found during an inspection of the day care, including inadequate staff training and improper child-to-staff ratios. Reports showed similar violations had been identified in previous years. No comments have been made by the lawyers representing either party, and the case remains ongoing.
