Montana Republicans seek to change judicial system rules
Republican lawmakers in Montana are upset with judges who block laws they pass. They believe that liberal judges are overturning their decisions. To address this, these lawmakers are looking to change the rules that govern the courts. Since the Supreme Court overturned Roe v. Wade in 2022, Montana has pushed for stricter abortion laws. They have passed three laws, but a district judge found them unconstitutional. In April 2023, lawmakers also banned gender-affirming care for minors. That law was also blocked by a judge. Additionally, a judge ruled that the state's support of the fossil fuel industry was against the public’s right to a clean environment. This ruling was upheld by the Montana Supreme Court at the end of 2024. Frustrated by these outcomes, Republican leaders have promised to take action against the judiciary. They are now proposing many bills that would change how the courts operate and affect who serves as judges.
