NJ Democrats push constitutional amendment for abortion rights
New Jersey Democrats running for governor are pushing to amend the state Constitution to guarantee abortion rights. Rep. Mikie Sherrill, who is leading in the Democratic primary, has made this change a key part of her campaign. Rep. Josh Gottheimer and former Senate President Steve Sweeney have also publicly backed the idea. Despite this, many legal experts believe the amendment is not needed. New Jersey already has strong abortion protections in state law, and legal advocates argue that a constitutional amendment would not improve women's rights. Nancy Erika Smith, a civil rights attorney, expressed concern that an attempt to amend could make New Jersey a target for conservative efforts. If the governor and state lawmakers want to change the Constitution, they must pass a resolution in two consecutive years or in one year with a supermajority. Then, voters would need to approve it at the ballot box. Democratic leaders believe that backing abortion rights can help them in future elections, especially after the fall of Roe v. Wade. Meanwhile, groups such as the ACLU and Planned Parenthood have shifted their focus to expanding abortion access rather than amending the Constitution. They assert that existing laws in New Jersey already protect abortion rights effectively. Some abortion rights supporters think the amendment could create political risks without real benefits. Democratic candidates are emphasizing the need for stronger protections, citing fears about potential changes at the federal level. However, several GOP candidates have also maintained that they do not plan to reduce existing abortion rights in the state. The conversation around this constitutional amendment continues to evolve as the election approaches.
