Paradise homeowner's lawsuit against builder paused indefinitely
A resident in Paradise, Thomas O'Brien, is stuck in a difficult position after his lawsuit against Karwood Contracting was put on hold. This happened because the company, which built his home, filed for creditor protection last month. O'Brien was frustrated to learn that he could not proceed with his legal case. He had already scheduled a settlement conference with Karwood but now feels powerless to address his problems with them. He believes the company had been aware of its financial issues long before they filed for creditor protection. O'Brien lives in a duplex and is unhappy that his yard and driveway remain unfinished despite a contract promising completion by June 30, 2023. He filed a lawsuit for $5,525 to hire other contractors but now finds his case paused. Greg Hussey, the owner of Karwood, listed several reasons for the company's financial troubles, including the COVID-19 pandemic and issues with lenders. His attorney mentioned that a monitor is managing the company's restructuring process, and they hope to resolve outstanding construction issues. While Hussey plans to emerge from this situation as a stronger company, O'Brien is skeptical. He doubts Karwood will fulfill its obligations and believes the company has consistently ignored customer needs. He feels betrayed and has lost all faith in Karwood's ability to complete the work at his home.
