RAK court denies woman's compensation claim for false theft
The Ras Al Khaimah Court of First Instance has rejected a woman’s claim for Dh50,000 in compensation. She alleged she suffered material and moral damages after being falsely accused of stealing from a villa. The court found no strong evidence to back the theft accusations. The woman, who was reported for breaking into the defendant's home, was declared innocent in the initial ruling. However, the court noted that the ruling focused on the lack of evidence against her, not on the truth of the incident. The court ruled that the defendant acted within his legal rights by reporting the alleged crime. As a result, the court concluded that the conditions for civil liability and compensation were not met. The defendant, represented by Hanan Salem Al Shammili’s Law Firm, reported damage to his villa and items stolen, including children's clothes. Although the defendant's claims were deemed credible, the appeals court acquitted the plaintiff. This clarified that while there was damage, the defendant did not intend to cause harm.
