Supreme Court warns buyers to check property titles
The Supreme Court has reminded home buyers to thoroughly check property titles and deeds before purchasing. Buyers should not rely solely on sellers' assurances and must examine original titles at the local Register of Deeds. In a recent case, the Court identified potential fraud, noting sellers were deceased before a sale and the resale price was significantly higher than the purchase price. The Integrated Bar of the Philippines has been asked to investigate possible misconduct by a lawyer involved in the transaction. Additionally, the Court clarified the difference between a "contract of sale" and a "contract to sell." Buyers gain ownership once certain conditions are met, even if full payment is pending, and cannot be evicted from the property.
