Tom Girardi's lawyers request delay of mental health hearing
Lawyers for Tom Girardi are trying to delay a hearing about his mental health evaluation ahead of his sentencing. Girardi, 85, was convicted on four counts of wire fraud in August 2024. He was found guilty of taking money from clients to support his lavish lifestyle, which included private jets, luxury items, and club memberships. Girardi's lawyers want to change the proposed hearing date from April 11 to May 16. They argue that he needs more time to consult with experts regarding his mental health. Prosecutors, however, believe he has had enough time to prepare and want the hearing to happen as scheduled. Sentencing for Girardi was originally set for December 2024. Prosecutors are seeking a 14-year prison term and more than $3.7 million in restitution. They claim he ran a Ponzi scheme that took at least $15 million from clients. Girardi's defense argues he should receive a lighter sentence of five to seven years. They say he suffers from dementia and poses no threat to society. They suggest he could serve time in a memory care facility rather than a prison. Among the victims, Kathy Ruigomez shared her story of how Girardi mishandled her settlement money following a tragic accident. She expressed frustration over the delays in justice. After his conviction, Judge Josephine Staton ordered Girardi to undergo a mental evaluation to decide on his sentencing options. The evaluation took place at a federal prison in North Carolina. A recent report stated that no further testing is needed. Girardi’s public defender is seeking additional time to discuss the evaluation findings before the hearing. The judge will set a sentencing date once the hearing results are available.
